Observations and Perspectives A matrimonial case may involve a myriad of issues, including, among others, custody, child support, maintenance and equitable distribution of real and personal property. A thorough investigation of all of the client's financial and other circumstances is essential to achieving a fair and equitable result, either through a negotiated settlement or litigation. Knowledge is the key to effective representation. Therefore, it is necessary at the outset of the case to gather as much information from the client as is readily available and to determine a specific strategy early on. This allows us to move the case toward an expeditious resolution, which is generally in the best interests of the parties and any children involved. One of our primary goals in representing a client is to assist the client in separating the purely emotional aspects of the case from the legal and relevant factual issues. An individual dealing with a divorce and other related matters is generally in a state of emotional upheaval. However, if emotional considerations cloud and unduly influence the client's judgment, it becomes extremely difficult for the client, as well as the attorney, to effectively deal with the case. Therefore, although a matrimonial practitioner must be compassionate with respect to the client's situation, in general the attorney will do a disservice to the client if the client's emotions are permitted to dictate the course of the litigation. It is also extremely important that the client have a reasonable expectation of what can be achieved under the circumstances. If unrealistic expectations are not dispelled early on, the result may be additional and unnecessary litigation between the parties and eventual conflict between the attorney and the client. |

Therefore, I believe that a matrimonial attorney has an obligation to advise the client at the outset of the range of results that may realistically be achieved. The client should also be made aware of the potential cost involved in litigating the issues in dispute. Although such honest and straightforward advice may be difficult for clients to hear initially, in the end most are generally thankful for having received it. The practice of matrimonial and family law has been extremely rewarding to me on many levels. I take particular satisfaction in the fact that by applying my experience and knowledge in the field, I have been able to assist clients in effectively working through extremely difficult and critical periods of their lives.
